Dear users, welcome to the privacy policy of the social network, social service and mobile application - PUPSI. The entire team at SunDate Inc., the developer and owner of PUPSI, would like to thank you for your time and for taking the time to read this document.

We trust you with our product and give you freedom of action, and you trust us with your information, your personal data, and we will tell you how and why we use personal information, where we store it and how we protect it. As the PUPSI app itself is simple and easy to use, our language is simple and concise, which means that any user without technical and specialized knowledge will be able to understand the essence of our privacy policy.

This Privacy Policy, its first version, comes into force today, which means that we announce the effective date of 13.06.2025.

1. Who are PUPSI

So far, we are a small international team of SunDate Inc., which has developed a social network and service for all people and pet lovers - PUPSI.

Our main team is from Ukraine, a country of golden fields and talented people. Our company, lawyers and part of the technical team are from the United States of America, the land of freedom and opportunity, inventors and discoverers.

In working with personal information, we primarily use the norms and requirements in accordance with the European GDPR (General Data Protection Regulation) and the American CCPA (California Consumer Privacy Act), as well as the principles of common sense.

We do not have many companies and servers that would be responsible for your personal information, but we do have our small team of talented specialists who make every effort every day to ensure that your personal information is protected and we use the most secure servers. In general, our main and so far only company is responsible for the protection and confidentiality of your information:

We primarily treat your information as our own. And we would like maximum protection and confidentiality for our information, so we do the same in relation to you.

2. Scope of SunDate and PUPSI Privacy Policy

This Privacy Policy applies to all SunDate Inc. products and services, unless any of the services has its own privacy policy, in which case its own policy shall prevail.

At the moment, the SunDate family includes the https://sundate.app website, the SunDate mobile application, and the PUPSI mobile application, hosted on two main platforms: the AppStore and Google Play.

As new services and mobile applications become available, we will notify you and add them to this document and together they will be referred to as "Applications" or "Services".

3. The information cycle in the world of SunDate and PUPSI

Sharing information in the digital world is like verbal communication in the standard world. In the world of SunDate, you and I also communicate through the communication medium.  You provide us with information about yourself so that we can process it and make your stay in the world of SunDate as efficient and enjoyable as possible. We also help other users see you through the information you provide, and show you other users based on your preferences. Everything is interconnected, and our main goal is to help users find these connections.

In the world of SunDate and PUPSI, you can share the following information about yourself with us:

- IOS (Apple ID) or Android (Google ID) account data, or email address for profile registration. When you sign up or sign in with your Apple ID, you authorize Apple to disclose your Apple credentials, your name, and your email address (you can hide your email address, and then Apple will create a random email address while keeping your email address private). This email address will be linked to your SunDate account and will be used to recover it. This personal information will be used to create your account in SunDate and PUPSI. If you remove the PUPSI app from your Apple ID settings, we will lose access to this data. However, we will retain the personal data that you provided to us when registering your PUPSI account with your Apple ID (you must delete your PUPSI account completely to deny us access to this data).

- Your first name, last name, date of birth and all data related to your pets, or any other information that you consider necessary to provide or our application will request from you.

- You also give us permission to process your geolocation information. Also, you need to add one photo as your profile picture.

- You give us the right to process and publicly use within the application the live videos you have made, which we call "LIFEES". You are solely responsible for the content of the content. Videos are subject to moderation at our discretion. By providing any information about yourself and your preferences, you consent to the processing of this information. 

- When you create comments, you give them the right to post them publicly, as well as to moderate or delete them if they have been reported or we consider them unacceptable.

- When you create any video, you communicate information in it that becomes public.

- When participating in our promotions, surveys, contests, you provide us with your information, and we collect and process it to improve the operation of our services.

- When communicating with us and our support center, we store and record all our communication, audio, video or text messages, in order to make our communication more effective and the service more functional.

- we process all photo and video content that you create, including photos or videos in your profile or when creating a tag in "MAPsi" mode, or when creating videos in "video LIFEES", "CATCHmaking", "ALERTsi" modes, as well as any information in your chats with other users, in order to make our SunDate and PUPSI world safer and more interesting.

If you post content that does not comply with our PUPSI Terms of Service, we may restrict or block access to your account.

We may also receive information about you from third parties, such as:

- Other platforms or social networks that you link to our services may share some information about you with us.

- Other users may share and transfer information about you to us if we are contacted.

- or our advertising and other partners may share information about you with us.

When you use our services, you also share the following information with us:

- We collect and analyze information about how you use our Services, when you visit, how long you use, what pages you are on, what search modes you use, who you communicate with, and other user information, i.e. what and when you click and watch. All of this information helps us improve our services and our PUPSI mobile app.

- Also, technical information about what device you use to use our services, what Internet connection, data from your device, GPS and other indicators such as time, date, time zone, or any other sensors of your device, as well as software and hardware, and other data that characterize your Internet connection and device will not be hidden from our attention.

- all other information related to your device and use of our services. You also give permission for the processing of your geolocation, i.e. the determination of your location (longitude, latitude using GPS, Bluetooth, Wi-fi). If you have given us your permission, we will be able to collect your location information in the background, that is, regardless of whether you use our service or not. Also, with your consent, we may collect information about your content that you upload through our services. 

If you are a California resident, we are pleased to inform you that all information we collect about you falls into the following categories of "personal information" as defined in the California Consumer Privacy Act (CPPA):

- H. Electronic, visual and audio data, such as photos and videos;

- I. Professional data related to employment, such as employment history and previous employer;

- K. Inferences drawn from the personal data listed above in order to understand, for example, the user's personal preferences or characteristics.

CAUTION Always remember that videos or photos you post on PUPSI may also reveal information about you. If you provide or upload personal information about yourself, you automatically provide us with your consent to process and publish it in the public domain.

4. PUPSI Information Collection Technologies

Unlike our functionality for users, where we have a lot of original innovations, in terms of information collection technologies, we will not surprise you with anything. Like all similar services, we use standard other technologies to recognize you as a user and for other identifications.

Taking into account the fact that all our services are mobile applications, we will not talk much about the DNT technology - the function of blocking the collection of information through a web browser. Let's just say that our services may not yet respond to DNT signals, like other similar products and companies.

5. How PUPSI uses information

The three main uses of information are to improve our services, to keep you safe, and to provide and personalize advertising.

- To provide feedback between us and you so that you are always up to date with all new events and products

- To develop and personalize content and advertising that may be of interest to you

- To provide feedback and analysis to improve our products, to develop new products based on your interests and recommendations, to develop new features, and to provide feedback to you to create the most interesting content

We recommend that you only upload information to our services that you wish to share with other users. We also recommend that you only upload and create content that you want to share with everyone. None of us can control other users and what they do with the information and content you share with them.

All information about you will be displayed in your profile according to your settings.

How PUPSI shares information with partners

Before exchanging any information with partners, they undergo the strictest integrity controls.

We may engage with and share information with some of our partners as part of improving our services, advertising campaigns, payments, analytics, and other operations. The exchange of information takes place strictly within the framework of the task performed.

How PUPSI and the SunDate team share information within their ecosystem

Over time and the development of our services, our ecosystem will expand, new products will appear and to ensure your comfortable and safe use of our services and products, and a quick transition from one service to another, we can share information within our services.

The exchange of information will be made in accordance with internal instructions and solely to provide technical data processing operations for marketing, hosting, advertising, operational support, to combat spam, fraud and other illegal activities, as well as to better understand our users and improve our services.

In order to ensure the interoperability of our services, we may also share information for business purposes in the future, when our structure includes different companies.

We may disclose and share information as part of the defense of our interests in court or other authorities if doing so would restore justice and reduce our liability for a lawsuit or claim. We will also need to cooperate with law enforcement authorities, both in your country and abroad, where required by law, as part of an investigation of a potential crime and,  if it is necessary to protect someone's vital interests. In such cases, we may retain or disclose your personal information, including your login credentials, if we have reasonable grounds to believe that it is necessary to comply with a law or legal regulation, or to comply with a legal proceeding, court order, or response to a request from a legal authority, or to protect the safety of any person, to respond to fraud, security threats, or technical problems,  for example, by using anti-spam service providers to protect against illegal activity or to ensure the security of our rights or property or the rights and property of third parties.

Marketing Service Providers. They help us perform marketing and advertising tasks on third-party websites and apps and measure the effectiveness of our advertising campaigns.

This includes the advertising identifier associated with your device (device ID), inferred location (based on IP address), age, gender, and data about your visits to and interaction with sites or apps (e.g., downloading or creating an account with an app) (CCPA categories B, C, F, G).

Payment and other telecommunications companies. Required to pay for our premium, value-added services

Business and corporate transactions. If SunDate Inc. changes its corporate structure, i.e. it is a takeover, merger, sale or in the event of any other corporate transaction, as well as in the event of insolvency, we may be required to disclose your personal data to the purchaser of all or part of the business, as well as to the insolvency practitioner

Compilation information. Our team may disclose aggregated compiled information to third parties, including your personal information (other than directly identifying you), as well as other information such as event log data for industry analysis and demographic profiling.

7. PUPSI and International Data Transfers

To ensure the security of personal data, we will use the most secure storage, and these may be located in different jurisdictions, i.e. in different countries, and as a result, the data may be transferred from one country to another. In the same way, the information that we described in more detail in the section "Sharing of information in PUPSI». We will try to ensure that all information has the highest possible level of protection, provided by the relevant treaties and technologies. For example, for the transfer of data from the European Union (EU), we use standard clauses approved by the European Commission and other appropriate safeguards for data transfers. If you want to know more about how data is stored and protected, you can contact us in any way convenient for you, and we will be happy to tell you everything in more detail. 

8. Rights of PUPSI users

In order for you to have free access to your account and to be able to see and manage your information, we provide users with special tools on our services, which you can familiarize yourself with by downloading our services or contacting us.

You can also control what data we collect and allow notifications. You can restrict, for example, the collection of data about your location, but be warned that any restrictions in the collection of the information we need may lead to restrictions on the functionality of our services for you.

If for some reason you do not like our service, our product, and you have a desire to delete it, then we recommend contacting us and maybe we will convince you otherwise, but if you still need to delete your account, then you can do it in the appropriate Settings. For some time, your data will be stored in an archived form, so that if you want to restore your account, you can easily restore your account.

Some laws governing the processing of personal information allow users to request information we hold about them. You can request information in any way convenient for you by confirming your identity.

You have the right to manage the information we hold and use about your information, so you can decide to change, make corrections or make other arrangements regarding your information by contacting us and making a request in any way convenient for you.

In order to protect your information, in the case of the above or other requests regarding personal information, we may carry out an identity verification procedure (request for identity documents, video call, etc.).

We do not recommend requesting information about third parties, but if you do, you must have a legal basis or permission from the person whose information you are requesting.

It is also important that if you make any actions or requests regarding the prohibition of the collection of information that is mandatory for the provision of our services, then you should know that we will either refuse such requests or may stop providing you with our services.

You have the right to uninstall our services yourself, you can delete the application, delete your account, or do both. In either case, the collection of your information will be suspended. If you delete your account, the information will be temporarily retained in case you want to resume your account without losing data. Also, if you delete the services from your device, we will store certain identifiers so that you can download our services again and resume their operation without losing your personal data. 

We will strive to fully meet your and international requirements for the processing and protection of personal information. But if you have any doubts about the quality of storage and processing of information, you can always, if the laws of your country allow, as it is allowed in the European Union, to file a complaint with the local authority, which is determined by the laws of your country.

According to Article 27 of the General Data Protection Regulation (GDPR), every company that handles the personal data of EU citizens or those who reside most of the time in EU countries must appoint an authorized representative in relation to the GDPR in the EU. As part of our commitment to GDPR compliance, we'll be appointing a designated GDPR representative in the EU as soon as possible, and we'll provide you with the relevant contact details in an updated version of this document. In the meantime, if you have any questions, you can contact us directly via email or social media, and we will try to answer all your questions.

9. Features for California (USA) Residents at PUPSI

The warm state of California is especially concerned about its residents, and therefore there is a special status for users in California where you can make a request to us to disclose information that we have shared with third parties as part of our marketing activities during the preceding calendar year. You can make a request by writing to us by e-mail. Once we accept it and verify your identity, we will collect and provide you with the relevant information. We will have 30 days to respond, so we will have to wait a little. But 30 days is not so long within the framework of the global universal flow of time.

Under the California Consumer Privacy Act, California residents, as described above, have the right to have certain information disclosed to them and to have their personal information known, used, and transferred in the past 12 months. Accordingly, California residents have the right to request deletion of personal information, subject to certain exceptions.

In accordance with the California Disclosure Act, Civil Code Section 1798.83, certain companies are required to respond to requests from California users regarding their practices for disclosing their personal information to third parties for their direct marketing purposes.

Sometimes, as part of promotions conducted in conjunction with third parties, we may disclose your contact information to these third parties so that they can offer you their products or services if you agree to participate in such a promotion. If disclosure of your contact details is a prerequisite for participation in the promotion, we will notify you in advance. Follow the instructions of third parties if you want to unsubscribe from their mailing list.

10. Data protection in PUPSI

We are a small but talented and hardworking family, the SunDate Inc. family and if you are with us, then you are also our family. As Lilo said: "Ohana" means "Family" in Hawaiian, and Family is when no one is forgotten or abandoned. Therefore, we make every effort to ensure that your information remains safe, so that our services bring you maximum pleasure and benefit. You are our family!

Of course, there may be someone who will hack and steal your information, we cannot guarantee that it will be absolutely invulnerable, but we make every effort to ensure that it is really invulnerable.
