1. ENTERING THE SUNDATE USER WORLD
At the moment, this is the only version of this document. We, the SunDate team, will try to set out all the Terms of Use of our product as simply and concisely as possible.

2. SUNDATE TERMS OF SERVICE CONSENSUS
By downloading and registering in our app, i.e. by creating an account, you automatically agree to these SunDate Terms of Service, as well as all other rules and regulations adopted by the SunDate team. All documents can be found on our website, which is indicated above.
We will try to make only those changes that will be for the benefit of both you and us, but do it as rarely as possible. We will endeavour to notify you of changes to this document and other documents through our service.
Of course, if you continue to use SunDate after changes have been made to this or other documents, you automatically agree to those changes.
In general, there is nothing particularly difficult, use SunDate with pleasure, prudently and with respect for other users, and just have a buzz, because each of us has only one sunshine life.
3. LEGALITY OF SUNDATE SERVICE
In order to use SunDate, as we have mentioned many times in our other documents, you must first be at least eighteen years old. That is, by the standards of many countries, you must become an adult. And by signing up for our SunDate app, you guarantee that you are at least 18 years old at the time of registration.
Or if your age under 18, You guarantee that you have parental approval, You confirm that you have obtained permission from your parent or legal guardian to use the app! And You guarantee that your age is not less than 13 years old or the minimum legal age in your country. By registering and using this app, You confirm that you meet this age requirements. If we determine that user does not meet the age requirements, we reserve the right to suspend or delete their account. All responsibility lies with the user!
You must also have the legal capacity to enter into legal contracts and be responsible for your actions, in your dealings with SunDate Inc. You must not be a person who, for any reason, has been prohibited by the law of the United States or other countries from using our or other social networks, services or gadgets and mobile applications in general.
You assume responsibility and obligation to comply with all norms and laws of the United States and other countries, local and international laws, as well as simply the customs of cultural communication and behavior.
You confirm that you are not a person who has been criminally prosecuted for sexual or other crimes of a violent, fraudulent, or other nature against others, and you do not need to register or register in any way because of such crimes.
But most importantly, you guarantee all of the above and are personally responsible for non-compliance with the above and below terms of this User Agreement.
4. LOGIN AND REGISTRATION FOR SUNDATE
After downloading our application, you need to register. After registration, you will be automatically logged in to the app and your account. Depending on where you downloaded the app, AppStore or Google Play, you will be able to quickly register using your Apple ID or Google ID.
Just remember that you are solely responsible for the security of your SunDate login credentials, and you alone are responsible for the activities that occur with your login credentials.

5. RELATIONSHIP WITH THE USER, TERMINATION OF THE RELATIONSHIP
The SunDate team works every day to improve our service. We cannot notify you of all changes, so by using our application, you automatically agree and accept such changes.
If necessary or if you violate our rules, we have the right to block your account, and if necessary, delete it. You can also delete your account yourself, for this you just need to go to the application settings, find the "Delete account" section, click "Delete", and confirm the deletion. But we do our best to make sure that once you download our app, you stay with us forever, even if we help you meet the love of your life. After all, we can help you find not only love, but also friendship, company and just help you have a good time online and offline.
As for purchases, at the moment we have everything free of charge, but all new in-app purchases will be offered to you and all in-app purchases made will be made of your own free will at your own risk and only you are responsible.
However, if you do delete your account, then in general all agreements with SunDate will terminate, except for those clauses that may affect our relationship even after you stop using our application. Clauses 5, 6, and paragraphs 13 to 20 of these SunDate App Terms of Service shall continue to apply.
6. YOUR RELATIONSHIP WITH OTHER SUNDATE USERS
This point is very important and we ask you to pay attention to it.
The SunDate team, for its part, does everything possible to ensure that the stay of users in our service is as pleasant and safe as possible. So the account is activated only after the user records and uploads the first live video directly in our application, which excludes fake accounts. We have come up with meeting cards so that you can immediately determine a safe meeting place and send the card to one of your close friends so that they know with whom and where you are going. We do many other things, but first and foremost, you are responsible for your safety. We can't verify users and tell you what they had in their bio, so it's up to you to choose who to chat with, who to reply to, but by tagging your video with "MAPA mode" or uploading your video to one of our video LIFEES modes, you give all users the right to watch and comment on your videos.
Also, by using SunDate, you automatically agree to the SunDate Code of Rules and Regulations for the World and undertake to read it for your own safety. You can find this and other documents on our official website listed above.
We remind you, and you warrant, that you will not share any personal, legal, financial, or other sensitive information with other users. We recommend that you do not communicate with users who will ask for such information or ask you for money or other financial assistance. Please notify us immediately about such users. Remember that you need to help people either through charitable fonts or only those whom you know personally, whose problems you know personally. Take care of yourself, your data and your money.
You are solely responsible for your relationship with other users, and you are solely responsible for your personal information. The SunDate team does not guarantee the fair conduct of other users, does not guarantee compatibility with them, as this is the personal choice of each user, does not check personal biography, criminal records, medical and psychological indicators.
However, with the help of all our tools, we try to make every user's stay in the world of SunDate as interesting, comfortable, efficient and interesting as possible.
7. SUNDATE GIVES YOU THE FOLLOWING RIGHTS
The SunDate team grants you the right, as well as the license, to free, individual, non-exclusive, revocable use and access to the SunDate service without sublicense. These rights and license will allow you to enjoy using our product.
As part of this agreement, we provide you with not only rights, but also some restrictions in order to ensure your and our safety. So, below we give a number of restrictions, that is, within the framework of this agreement and license, it is prohibited:
- Use our SunDate service, content or other information obtained within the service for any commercial purpose without our consent;
- use, duplicate, copy, transmit or otherwise do with any copyrighted marks, materials, images, pictures, animations, videos, trade names, any proprietary information or text, any other intellectual property that can be found on SunDate without our prior consent;
- falsify any consent or statement by SunDate;
- use any automated programs, such as using robots, bots, automated algorithms, scrapers and spiders, website crawlers, proxy servers, extract, index or perform other actions to recreate, copy, repeat the appearance of the UI/UX or SunDate's internal algorithms, as well as perform any actions to circumvent or disrupt navigation algorithms and the system;
- take any action that may adversely affect the operation of SunDate, both the application and the service, and the servers and network of our service;
- use viruses or any code that may harm SunDate;
- copy or forge headers or other information, manipulate identifiers and disguise the origin of information obtained from SunDate;
- without SunDate's permission, make a copy, "mirror or frame" of any part of this product;
- redirect any person from the SunDate service to another website or service for any purpose, i.e. use meta tags, software code, or any device that contains links to SunDate, our service, SunDate's trademarks, trademarks, logos, animations, slogans or service marks for such redirecting;
- take any action to disassemble, modify, copy, adapt, translate, sell, sublicense, reconstruct, decipher, compile or decompile any part of our service, whether or not by causing anyone else to do so;
- develop and use programs or applications that link to or interact with SunDate or other users' content, without the consent of the SunDate team;
- use or interact with the SunDate API without the consent of the SunDate team;
- research, scan, test or take any other action aimed at finding vulnerabilities in our SunDate product, servers, network or other systems (but if you do find a vulnerability in violation of these rules, we encourage you to contact us immediately);
- violate these SunDate App Terms of Service or encourage others to do so.
In the event of a suspected violation, SunDate has the legal right to take all necessary actions to identify such violation and terminate the violation, so we have the right to block or delete your account, or take any other legal action.
We also inform you that our SunDate product or any other software that we provide to you may automatically download and install updates and new features. If you want to change this, you can do so through the settings menu on your smartphone.
8. SUNDATE GRATEFULLY ACCEPTS THE FOLLOWING RIGHTS FROM YOU
By downloading and creating an account with SunDate, you automatically transfer to the SunDate team the following rights, namely, royalty-free, assignable, non-string rights with the possibility of creating a sublicense and license to host, use, store, make copies, display, adapt and edit, reproduce and publish, modify, distribute the information that you contribute to the system or make available through third-party sites, as well as all information, that you publish, create, upload, display, or share with other followers. This right is exclusive only in the case of and in relation to content created exclusively with SunDate. That is, the SunDate team has exclusive rights to the content created within the service. Although we protect our users' information and content from being copied or downloaded, just in case, you grant us the right to act on your behalf regarding violations regarding the use of your content extracted from our service by third parties without your or our permission. We have the right to send notices on your behalf to violators of your and our rights. Our right and permission to use your content is used solely for the purpose of ensuring the operation and functioning of SunDate, developing, modernizing the service, providing the best possible service, and for research purposes to develop new products and applications.
You also authorize, by posting your content on SunDate, that it may be viewed by all other users or other persons browsing the service or participating in its development or operation, including persons who receive content as a forwarding from other SunDate users.
You solemnly swear and confirm that all information you provide on our service is the pure truth and nothing but the truth, and that you have all legal rights to create and post content on SunDate and have the right to grant us the above license and rights.
You grant us the right and permission to review all information and content that you upload and create to SunDate, and the right to remove or obscure related content, comments or any other data if it is, in our opinion, contrary to SunDate's moral and ethical, legal or world regulations in accordance with this agreement and other internal documents that you can consult on our official website or inside the mobile application.
We ask that you observe the rules of decorum and friendly communication when you correspond or talk with our support team or other employees. We do our best to make your stay in the world of SunDate enjoyable, interesting and effective, so please treat our staff with respect. In the event that we deem your behaviour unacceptable, we reserve the right to suspend your account or remove it from the SunDate world altogether.
We give you the right and opportunity to use our service, and you agree that we, our partners and affiliates have the right to advertise on our service.
If you have any suggestions, comments or ideas and you send them to us, then we become their copyright holders and can use them for any purpose without paying you monetary or other compensation.
In the event that we receive a court order, or if it is necessary to enforce this agreement, or to assert a claim that your content violates the rights of third parties, to respond to your support request, or to protect and safeguard any rights or personal safety of the SunDate team, or in general, the company and our product, or third parties, We may receive, disclose, or store information about your account and content if we believe that such acquisition, retention, and disclosure is lawful and for the benefit of the parties.
9. SUNDATE COMMUNITY GUIDELINES
Our rules are strict, but they exist to make your stay in the world of SunDate comfortable, fun and efficient. So, we need to introduce a number of restrictions for all users to ensure the harmony of the SunDate world.
As soon as you download SunDate and register, you automatically agree that you are prohibited from:
- use or use our application for purposes other than those for which it is prohibited by these terms of use;
- use or use our application with malicious intent, for criminal purposes, or to the detriment of other people and users;
- use or use our application to harm or damage the team and SunDate Inc. as a whole;
- engage in any act that violates all of our public documents that you automatically agree to by downloading and registering with SunDate and which you can consult on our official website;
- in any way send spam to other users, ask them for money or other valuables, ask for personal information that relates to finances, insurance, business or other especially personal matters;
- pretend to be another person, tell lies about yourself, publish videos with other people against their will and without their consent;
- perform any actions that may harm other users, both psychologically and physically, namely, bullying, insulting, harassing, threatening or humiliating other users, as well as disseminating false, defamatory and offensive information about them;
- create and post video, photo content that violates the rights of other people, including the right of privacy, copyright and related rights, intellectual property rights, trademark or patent rights, and any other rights that arise from this agreement;
- create and post video, photo, content with threats, insults, with calls that incite hatred or violence;
- create and post video photo content of a sexual and pornographic nature, video photos with nudity, video photos with scenes of violence against yourself or other people or animals;
- create and post video and photo content with elements of racism, hatred, intolerance, sexism, and other unfriendly and anti-human elements, including physical threats;
- Solicit or otherwise attempt to obtain financial or other personal data and attempt to use it for your own mercenary, commercial or other unlawful purposes;
- distribute other users' personal information, personal data, or any other information that other users have entrusted to you without their permission;
- Create more than one account, use another user's account, allow other users to use your account, or create a new account after we have blocked and/or deleted your previous account for any reason and you have not received permission from us to create a new account.
The SunDate team has the absolute and full right to investigate and, as a result, block and terminate your account without material refund of the cost of any purchases you have previously made, or compensation for moral or other damages, if you have violated these SunDate Terms of Service, or our other public documents, or abuse our service, or the SunDate team has found out and decided that your conduct, your actions and communications towards other users, whether within or outside of the SunDate world, are in violation of the law and are simply unacceptable and immoral.
Be polite to each other, be tolerant and kind to each other, be indulgent and respectful to each other, because by respecting other people, you also show that you respect yourself, which means that you are worthy of attention, friendship and love of other people.
10. RESPONSIBILITY FOR SUNDATE CONTENT
The content that is created and uploaded to SunDate is the sole responsibility of the user who uploaded the content. We review and, if necessary, remove content that does not comply with the terms of these SunDate App Terms of Service, however, we cannot guarantee that we have been able to remove all such content or that the remaining content complies with these SunDate App Terms of Service. If you see content that violates these SunDate Terms of Service, please let us know in any way you like, such as by email or through our service.
11. SHOPPING AT SUNDATE
From time to time, the SunDate team may offer you to make purchases within our service, i.e. to purchase a product or service, hereinafter referred to as "Purchases". You can make purchases through the App Store, Google Play Store, mobile operator, SunDate payment service and any other payment service or platform that works with the SunDate App. In order to make a purchase, you need to confirm the payment by pre-selecting the payment method and operator for payment. By confirming the payment, you give the SunDate team and the payment processor your permission to charge the relevant amount. The amount of payment includes all commissions and taxes.
At SunDate, we offer you both one-time purchases of certain additional features and subscriptions. When you purchase a product under a subscription, if the subscription expires, the subscription automatically renews under the same terms for the same period, unless you cancel it. This is how your payment data is stored for your future purchases and automatic renewal of purchases. Accordingly, you can go to your SunDate settings or third-party payment processor settings and cancel your subscription. If you cancel your subscription and pay automatically with your card, you will be charged the fees you are due at that time.
If you do not agree with a payment that has already been made, you can contact us and object to the payment made if it was made directly to SunDate. You can also contact a third-party service to dispute the payment if the payment was made through it.
In order to cancel your subscription, you need to follow the instructions for canceling your subscription with both SunDate and the third-party payment provider. If you delete your account or uninstall the SunDate app, your subscription will continue and you will be charged automatically until you cancel your subscription. After cancellation, the subscription continues exactly for the period for which it was paid for and terminates at the end of the subscription period. That is, you can safely use the benefits of the subscription until its expiration and then you will not be charged.
When sending payments directly through SunDate, we have the right to change payment details and/or correct errors in payment details, even after a payment request has been submitted or payment has been received. If you cancel a payment or initiate a refund using your chosen payment method, we have the right to terminate your account.
You can change your payment method at any time in the Settings section of SunDate. In the event that the payment does not go through in any way, and you do not cancel your subscription or change the payment method, then you are responsible for the outstanding payments and such payments will be made by us after you make changes to the payment method. You also give us the right to receive updated information about your credit card from the card issuer.
As we have already said, all search tools in our service are open forever, but we may impose some restrictions on their use, but we may not block access to them. We can also create virtual items and coins that you can purchase and use within our SunDate service to exchange for additional features and other products, or for other purposes that we provide and make available for use within the SunDate service. By purchasing virtual items or coins, you receive a personal, limited, non-transferable, non-assignable right to use them, which is also a non-sublicensable license. The balance of virtual items or coins is a simple representation of the scope of your rights and your license. If we terminate your account, we will automatically terminate your license for virtual items and coins and you will not be entitled to a refund. We can change the cost of virtual items and coins, distribute them for a fee and for free, as bonuses. We have the right to perform any actions in relation to virtual items and coins without your consent. In doing so, we will not be liable to you or others. If you have purchased and received virtual items or coins through our SunDate service, such purchase is final and is not subject to refund, compensation. You also confirm that the team and SunDate Inc are not obliged to compensate you for the cost of virtual items and coins, or in any other way return their value if your account is voluntarily, involuntarily or in any other way closed, blocked and/or deleted.
As for refunds, no purchases will be compensated. Also, as we mentioned earlier, the funds you spent on the purchase of a subscription are not refundable if you cancel or close your account. Refunds are only possible if expressly provided for in the laws of your country and if such a request is received within fourteen days from the date of payment. The request will be considered by us and a decision will be made on it.
For example, under the laws of the European Union and the European Economic Area, residents are entitled to such a refund of the subscription fee within fourteen days, upon application. This period begins when the subscription begins.
If you made purchases through or using your Apple ID and App Store by Apple Inc and not SunDate, your refund will be processed through Apple Inc.
If you made purchases through or using Google ID (Google Play Store), then refunds will be processed through this service of Google LLC.
If you have purchased directly through SunDate, you can contact us directly via email by contacting customer service, respecting the above deadlines and the laws of your country.
The funds will be refunded in the same way as the payment was made.
If you made a purchase through any other payment platform, then you will have to contact the support service of this platform directly.
Purchases of virtual items and coins (tokens) are final and are non-refundable and non-refundable.
The SunDate team reserves the right to apply any pricing policy at its sole discretion. Taking into account the fact that we are expanding our activities to the whole world, prices may vary depending on the country of operation of our service. However, we will try to ensure that our pricing policy fully satisfies you and for a reasonable price you receive the highest level of service.
12. SETTLEMENT OF COPYRIGHT INFRINGEMENT ISSUES IN SUNDATE
If you believe that your copyright or the copyright of the person or organization you represent has been infringed, please contact us immediately in any way convenient for you.
We can be contacted through social media or email, which are listed on our official website.
As part of our cooperation to remove copyright infringement, we ask you to provide us with the following information: type of copyright, copyright owner, proof of authority, description of the infringement, and location of the copyright infringement on our service. You will be required to make a written statement, in which you will also have to confirm that the copyright holder has not given his permission to use the subject of copyright, that all specified information is true and that you are the legal owner of the copyright or the legal representative of the owner. You will also be required to provide your contact details and the contact details of the copyright holder.
For our part, we guarantee maximum assistance in the restoration of your copyright. In the event of a repeat violation, we will delete the account that committed the violation.
13. DISCLAIMER OF ANY LIABILITY BY SUNDATE
SunDate provides the service as it is in all its beauty and with all its flaws. The SunDate team tries to bring the service into compliance with applicable laws as much as possible, but does not guarantee it. SunDate Inc. makes no warranties or suitability for the service, in particular no warranties of quality, merchantability, fitness for any purpose, or non-infringement. SunDate makes no warranty that the service will be uninterrupted, secure or error-free, or free of glitches or defects, and does not warrant that defects or errors will be corrected, but we will endeavour to do so. SunDate Inc. does not guarantee that the information you receive on the service is true or accurate.
With respect to content, SunDate Inc. is not responsible for any content that you, other users or third parties post on our service, upload, view, or access through the service.
You are solely responsible for the consequences after uploading, viewing or posting content on our service, and perform any other actions with the content at your own risk.
14. THIRD-PARTY ENGAGEMENT AND SERVICES
SunDate may contain advertisements or advertisements from third parties, they may offer you their products or services, however we are not responsible for the availability and quality of such products or services, or the integrity of such third parties. SunDate is not responsible for the availability, unavailability or correctness of external sites and resources offered to you by third parties. In the event that you, while in our service, decide to interact with such third parties, then we are not responsible for the actions of such persons and your relationship with them is regulated by the internal documents of such parties.
We ask you to be careful about interaction with third parties and study the terms of use of third parties.
15. SUNDATE'S LIMITATION OF LIABILITY
SunDate's team and company, in accordance with applicable local, federal and international laws, and its employees, affiliates, partners, affiliates, licensors or third-party service providers SHALL NOT BE LIABLE for any damages, such as indirect, consequential, consequential or incidental, punitive or special damages, any loss of profits or loss, loss of data and information, for damage to your reputation, health or any other damage, or any other intangible loss, suffered as a result of you accessing or using, or failing to use, or accessing the SunDate service, as a result of other subscribers or third parties uploading certain content or doing any other thing in connection with our service, as a result of illegally accessing, using, copying or modifying your content, even if SunDate knew or could have known of the possibility of such damages. The above limitations of our liability apply only if they do not expressly conflict with the applicable laws of a particular jurisdiction.
In any case, if there are any complaints, we are always happy to settle them peacefully and with the utmost care for our customers, our users, our family.
16. ARBITRATION CLAUSE
Dear users, this is a very important clause of these Terms of Use and we ask you to read it carefully. By downloading our service and using SunDate, you automatically agree to this Arbitration Clause.
We are a young team that tries our best to make the world of SunDate as comfortable, interesting, fun, efficient and most importantly safe as possible for all users. We are not immune to mistakes and if you believe that we have somehow violated your rights and legitimate interests, and you have a desire to restore them, then before contacting lawyers and the court, we ask you to contact us through social networks or the e-mail indicated on our official website:

You and we agree to use our best efforts to settle any matter or conflict amicably and you agree to contact us and try to resolve the dispute amicably before taking legal action.
If it is not possible to settle amicably, then this arbitration clause applies.
For all disputes in all jurisdictions where this arbitration clause applies, any dispute that arises shall be brought before the JAMS Arbitration, Mediation and Alternative Dispute Resolution Center in accordance with their Arbitration Rules, subject to all requirements of this clause.
Disputes in this arbitration will be heard by a single arbitrator selected from the JAMS list of arbitrators. JAMS provides arbitration, but does not conduct it. You and we waive oral hearings, so the arbitrator can make his decision based on written testimony and evidence. Upon the issuance of the decision, SunDate Inc has the right to file a counterclaim or appeal.
You also agree not to participate in, support, or be a party to any class actions, class arbitrations, or other representative actions, processes, or activities against SunDate Inc.
You also waive your right to go to court to bring a claim or action, except if the matter falls within the jurisdiction of a small claims court. As previously stated, you are also waiving the right to participate in class actions and other class actions.
In the event that the case cannot be brought in small claims court or JAMS arbitration, or this arbitration clause is found to be invalid, then any legal proceeding against SunDate Inc may be commenced only in the U.S. federal or state courts located in Kent County, Delaware. You irrevocably acknowledge and agree to the jurisdiction of these courts.
17. GOVERNING LAW
The applicable law for all jurisdictions shall be the laws and laws of the State of Delaware, U.S.A., excluding the conflict of laws principles and rules of the State of Delaware.
18. PLACE OF CONSIDERATION OF DISPUTES AND CLAIMS
As previously mentioned, all disputes must be heard in JAMS, if this is not possible for some lawful reason, then disputes must be heard in small claims court, if this is not possible for legitimate reasons, then all disputes must be heard exclusively in the federal courts or the courts of Kent County, Delaware. You and SunDate Inc consent to the jurisdiction of the foregoing courts and waive the claim that there is no close relationship between the venue and the dispute.
For users residing in the European Union or the European Economic Area, as well as in other countries outside the United States, including our home country of our project, our beloved Ukraine, this arbitration clause also applies to you, unless it directly conflicts with your local and international consumer protection laws. In the event that this arbitration clause does not apply to you and is found to be invalid, then international consumer protection law and other applicable international law, including your local law, will apply, unless it conflicts with international law.
19. WARRANTIES ON THE PART OF THE USER
You agree to indemnify and hold harmless SunDate Inc., our partners and affiliates, their and our employees and officers, directors, agents from and against any and all claims, demands and liabilities, and shall indemnify and hold harmless any losses, costs, damages, expenses, including attorneys' fees, arising out of or in connection with your access to or use of the SunDate Service, your content or any breach by you of these SunDate Terms of Service.
20. MISCELLANEOUS
These SunDate Terms of Service, as a legal agreement, also include: the SunDate Pledge, the SunDate App Privacy Policy, and any other terms and agreements open and available to you, agreed with you when purchasing or receiving additional features, services and other products as part of our service, and in general, all of the above documents constitute a valid agreement and contract between you and SunDate regarding the use of our service.
In the event that any part of this agreement or other above documents is declared invalid, then only the part that is recognized as invalid loses force, and the rest of the agreement and documents remain valid and have legal force.
If for some reason we once decide not to apply this or that provision of this agreement or any of our rights, this does not mean that they lose their force. Such provisions, rules and rights may be applied by us at our discretion in the future.
You agree that your SunDate account is solely yours and is not transferable under any circumstances and in the event of your death, the rights to your account, content and other information therein will terminate.
You are not authorized to act on behalf of SunDate Inc, or to make representations on our behalf, or to enter into obligations on behalf of SunDate Inc.
